A proposed statute filed yesterday would limit the amount of ground vibration allowable in Miami-Dade County for construction materials mining activities and eliminate certain administrative dispute resolution avenues for claims against companies involved in construction materials mining activities.
Construction Materials Mining Activities - HB 143
Under the proposed statute, a new paragraph is added to section 552.30, Florida Statutes, specifically limiting the ground vibrations that are allowed in Miami-Dade County. Further, the amended statute would allow the State Fire Marshall to modify these limits.
In addition to these changes in Miami-Dade County, the revised statute would eliminate the current administrative hearings process for dealing with damages caused by construction materials mining activities and shift those into state court.
This is a proposed statute, and we will keep you posted on any changes to its status.
