Proposed Florida Senate Bill 352 would remove the requirement for a notice of commencement to be recorded on HVAC contracts directly with homeowners that total less than $15,000.00. The current statute eliminates the need for a notice of commencement on direct HVAC contract of less than $7,500.00.
It is important to note that this only impacts projects where a contractor is entering into a contract to repair or replace an existing HVAC system. It does not apply to projects where an HVAC contractor is a subcontractor on a larger project, or where the HVAC contractor is installing a new system.
If passed, this statute would take effect July 1, 2022. We’ll keep you posted on any updates or changes.
