New Statute Would Update Regulations on Low Voltage Electric Fences and Low Voltage Alarm System Projects

The new statute would affect low voltage electric fence installations and limits municipalities from imposing requirements on low voltage alarm system projects that exceed those set forth in 553.793, Florida Statutes.

If signed by the governor, 553.793(3), Florida Statutes, would be modified to change low voltage electric fence installations as follows:

  1. A nonelectric fence or wall must completely enclose the outside perimeter of the low-voltage electric fence, and the low voltage electric fence must be 2 feet higher than the perimeter fence or wall.

  2. Low voltage electric fences are allowed in any area unless the area is zoned exclusively for single family or multi family residential use. An area with more than one zoning category cannot be considered to be exclusively zoned for single family or multi family residential.

The new statute also modifies 553.789, Florida Statutes, to prohibit a municipality, county, district, or other entity of local government from enacting an ordinance or rule that provides additional requirements beyond those set out in that section for the installation or maintenance of a low-voltage alarm system project, or imposing requirements that are inconsistent with the statute.

If approved by the Governor, this law would take effect July 1, 2024.
